President's Cabinet By- Law
I. It is recognized that the Student Body President is the head of the executive branch of the Student Government and the highest individual representative and administrator of the Student Body.
II. It is also recognized that the numerous duties and responsibilities of the Student Body in Student Government require the division and delegation of these duties and responsibilities to several departments known as the "Cabinet".
III. The Cabinet is directly responsible to the Student Body President, in whose name the Cabinet functions.
IV. The Cabinet shall be directed by the Vice President of the Student Body.
V. In addition, the Cabinet is responsible to the Student Senate which, in cases, relies upon the Cabinet for certain administrative and communicative functions.
VI. It is further recognized that it is desirable that the number of Cabinet officers be kept to a minimum in order to concentrate effective responsibility and administration, facilitate communication, and increase prestige and pride in one's work as an encouragement toward maximum performance. It is highly undesirable that these qualities be lost with an increase in the number of Cabinet positions delegating little individual responsibility to numerous persons and creating positions for mainly political purposes.
VII. The Cabinet shall consist of one or two name(d) representative(s) from each of the subject areas set forth in Section XI herein; said representative shall be a full- time student with a minimum 2.0 GPA, and he/she shall be responsible for all functions delegated to that area. In addition, the subject areas representatives shall be responsible for keeping the Student Body President, and when necessary the Student Senate, advised of the activities and operations of their respective subject areas. Each of the subject area representatives shall be responsible for submitting to the Information and Investigation Committee of the Student Senate at least once each academic term or when the Chairman of Information and Investigation requests a detailed written report concerning the activities of that representative, his/her subordinates, and his/her particular subject areas. All Cabinet reports shall be kept in the Student Senate files. This section shall take effect upon passage, but under no circumstances shall it be applied to previously approved Cabinet officers.
VIII. One or two name(d) representative(s) from each subject area designated in Article XI herein shall be appointed by the President of the Student Body with the approval of a majority vote of the Student Senate present and voting at a regular meeting. If an appointed representative does not receive said approval, the Student Body President shall submit another appointment to the Senate Replacement and Agenda Committee for said subject area within fourteen (14) calendar days of the vote of non-approval in the Student Senate; otherwise the Student Body President shall be guilty of non-feasance.No person shall serve as a Cabinet Director from any subject area for more than fourteen (14) calendar days without first appearing before the Replacement and Agenda committee for the purpose of being interviewed. The Chairperson of the Replacement and Agenda Committee shall arrange the interview of the appointee from the subject area at a time agreeable to both. After being interviewed, no person shall serve as a Cabinet Director from any subject area for more that fourteen (14) additional calendar days without being approved by the Student Senate. The Senate Replacement and Agenda committee and the Student Senate shall have the power to grant temporary excuses when deemed necessary and proper. This provision shall not apply when the Senate is not in session.
IX. Any member of the Cabinet may be removed from office by the Student Body President.
X. Subject area representatives may appoint whatever assistants or committees necessary for the effective functioning of their areas. Such assistants or committees are directly responsible to their subject area representatives.
XI. The Executive Cabinet shall consist of the following areas:

5. Capital Improvements

7. Community Affairs
8. disAbility Affairs
9. Environmental Affairs
10. Evaluations
11. Health
12. Interactive Services

21. Women's Affairs
XII. No additional subject areas may be designated without amending this By- Law.
XIII. The Student Body President or other elected officers of the Student Body may appoint administrative aids to assist outside of the Cabinet.
XIV. The Student Body President is hereby authorized to establish whatever formal title, offices, departments, divisions of labor, chains of command, or other necessary structural bureaucracy as he may, in his discretion, deem appropriate for the efficient operation of the Executive Branch - subject only to provisions that no office or department may be formally created as superior to the Cabinet. The Student Body President shall be prohibited from appointing an executive director or any other structured bureaucracy in the place of a Cabinet Director.
XV. Members of the Cabinet shall have speaker's privileges, excluding debate, in the Student Senate as officers of the Student Body and shall be recognized as official representatives of the Student Body in relation to the functions of their respective subject areas. In addition, cabinet directors shall make an oral report to Student Senate, on a semester basis, on the status of their respective cabinet, as scheduled by the Senate President.
STUDENT BY- LAW NO. 2:
Installing of Student Senate.
I. Elections of student senators shall be canvassed within ten (10) days of the election by the Student Senate. The Student Senate shall be the sole judge of the validity thereof and qualifications of the members elected and shall rule on the validity of elections within eight (8) days of canvassing.
II. Elected senators shall assume the duties of their elected positions upon being sworn in by the current Chancellor of the Student Honor Court or his/her designee.
III. The Chancellor or his/her designee shall swear in these members immediately following validation.
IV. Newly elected Student Senators shall be installed at the next regular Senate meeting.
STUDENT BY- LAW NO. 3:
Student Government Election By- Law: (87- 149, 94-123)
I. Student Government Fall semester elections shall be held on Tuesday and Wednesday of the seventh week of the Fall semester.
II. Student Government Spring semester elections shall be held on the first Tuesday and Wednesday after the second Monday in April of the Spring semester.
III. Student Government run- off elections, if necessary, shall be held on the first Tuesday and Wednesday after the third Monday in April of the Spring semester.
IV. Amendments to this by- law may not be made in the four week period proceeding the last day of qualifying for the election for which the amendment is to take effect.
STUDENT BODY BY-LAW NO. 4:
Student Government Finance manual By-Law:
I. The Treasurer of the Student Body shall issue periodically a Finance Manual designed to achieve efficient operation and compliance under the finance law.
II. The aforementioned Manual shall be considered the enumeration of the finance policy of Student Government.
III. The policy enumerated in the aforementioned Manual may be suspended in a specific instance by the Treasurer, with the approval of a majority vote of the Student Senate: or by the Student Senate, with the approval of the Treasurer, as would be indicated by placement of his signature on the funding bill passed by the Student Senate under such a suspension of the Student Government finance policy, as enumerated in the Finance Manual.
V. Amendments to the Finance Manual shall be initiated by the Student Body Treasurer and approved by a majority vote of the Student Senate before becoming part of the Student Government finance policy as enumerated in the Finance Manual.
VI. Organization, updating printing, and distribution of the Finance Manual shall be under the responsibility of the Office of the Student Body Treasurer.
STUDENT BY-LAW NO. 5
Code of Ethics for the Student Senate By-Law:
I. Student Senators are elected by the students of the University of Florida to serve the Student Body of the University of Florida.
1. Student Senators will work in a direction that is in benefit of the students at the University of Florida.
2. A Student Senator shall not knowingly serve self- interests and should make reasonable efforts to avoid conflicts of interests.
II. Every Student Senator has the same debate and voting privileges.
1. No Senator shall interrupt, disrupt, or mock a Senator at any time when the Senator is addressing the Body.
2. Senators should not attempt to eliminate relevant debate on the floor.
III. Committee membership is both an honor and a responsibility.
1. Senators forced to resign from Senate Committees due to absences are recommended not to interview for those seats again.
2. Senators signing over their Senate Seats in the Summer Replacement process do not automatically regain their committee seats when they return in the Fall.
3. Senators must perform their assigned committee duties as stated in the Senate Rules and Procedures so that the committee work is efficient. Senators that do not wish to do so should resign their committee seat to a willing senator.
IV. When performing duties, Senators shall act in a manner that fits the decorum of the Student Senate of the University of Florida.
STUDENT BODY BY-LAW NO. 6
I. The President of the Student Body shall have the ability to veto any line item in either the Activity & Service Fee Budget Act or the Student Government Funded Organizational Budget Acts.
A. The President's line item veto and his explanation must be submitted in writing to the President of the Senate and the Chairman of the Budget Committee, no later than the tenth calendar day following final passage of the Act from which the line item was vetoed or the President will have forfeited his right to line item veto under this by-law. The SB President shall notify the President of the organization whose budget was subject to veto within seven calendar days of the veto, by certified mail.
B. The Student Senate shall have the power to override the President by a two-thirds vote of the Senate present and voting approving the line item, the objection of the Student Body President notwithstanding.
II. The Treasurer of the Student Body shall have Line Item Veto power equal to that of the President of the Student Body.
A. The Treasurer's line item veto and his explanation must be submitted in writing to the President of the Senate and the Chairman of the Budget Committee, no later than the tenth calendar day following final passage of the Act from which the line item was vetoed or the Treasurer will have forfeited his right to the line item veto under this by-law. The SB Treasurer shall notify the President of the organization whose budget was subject to veto within seven calendar days of the veto, by certified mail.
B. The Student Senate shall have the power to override the Line Item Veto of the Treasurer by a two-thirds vote of the Senate present and voting approving the line item, the objection of the Student Body Treasurer notwithstanding.
III. If both the President and the Treasurer Veto a particular line item, the Senate may override both by passing by a two-thirds vote of the Senate present and voting to approve the line item, the objections of the Student Body President and the Student Body Treasurer notwithstanding.
IV. Any organization that has their budget or any line item within said budget vetoed under this by-law, may submit a Supplementary Appropriations Bill to the Senate Budget Committee for consideration.
STUDENT BODY BY-LAW NO. 7
I. The Constitution of the United States of America, the Constitution of the State of Florida, and the Constitution of the University of Florida Student Body guarantee certain inalienable rights to the students of the University of Florida. The Student Body Government and its officers shall protect and defend the rights outlined within this by-law.
II. The following rights are ensured and protected and shall not be abridged. These shall be defined as:
A. The right to exercise an establishment of, or absence of a religion; and/or express freedom of speech; and/or to peaceably assemble.
B. The right to be secure in their persons, property, and residence, against unreasonable searches and seizures without probable cause and due process.
C. The right to not be put twice in jeopardy for the same offense; nor to be a witness against him/herself in any offense.
D. The right to judicial due process, including information of the nature and cause of the accusation, a speedy trial, confrontation of witnesses by parties accused, assistance of counsel for defense, presumption of innocence, right to choose the appropriate tribunal which shall hear the case, right to appeal, and protection against cruel and unusual punishment.
E. The right to academic freedom.
F. The right to join and participate in any group or organization for any legal purpose.
G. The right to establish and disseminate publications without censorship; and to invite and hear any person on any subject without a clear and present danger to health and safety or any individual.
H. The right to all privacy rights guaranteed by the Constitution of the United States of America, the Constitution of the State of Florida, and the Constitution of the University of Florida Student Body.
I. The right to petition the appropriate governing bodies or officials of the University for redress of grievance.
J. The right to all rights and privileges without denial on the basis of race, color, creed, gender, sexual orientation, national origin, age, religion, or physical ability.
K. The right to bring suit within the appropriate judiciary structure for any violation of rights in this document, the Student Body Constitution, the Constitution of the State of Florida, and the Constitution of the United States of America,
L. The right to remove student body officers on the grounds of malfeasance, misfeasance, nonfeasance, or abuse of power and responsibilities of the office presently held (as defined by Student Body Statutes).
M. No part of this by-law shall be considered to guarantee funds to exercise any of the rights enumerated, implied, or otherwise construed in this by-law.
III. The enumeration of these rights is not intended to diminish other rights held by the students of the University of Florida.
STUDENT BODY BY-LAW NO. 8
I. The word days, as used in the Student Body Constitution, Student Body By-Laws, Student Body Statutes, shall mean calendar day(s), unless other wise specified.
STUDENT BODY BY-LAW NO. 9
All University Committees that provide for the administration of student fees shall have at least one (1) student member that will be reappointed by the President-Elect of the Student Body for an additional one (1) year term.
These said committees shall include:
1. The Activity and Service Fee Committee
2. The Health Fee Committee
3. The Athletic Fee Committee
