HB 369 by Representative Mario Diaz-Balart - Career Service Extreme · Removes requirements relating to Affirmative Action Plan. · Abolishes Public Employment Relations Commission (PERC) in favor of newly created Division in the Department of Management Services (DMS). · Guts collective bargaining; ULP's (Unfair Labor Practices) go to Circuit Court (Court costs and Attorney fees). · Shifts Age Discrimination and Veteran Appeals to Circuit Court rather than PERC (Court cost and Attorney fees). · Increases outsourcing and privatization, while providing that layoff/recall rules do not pertain to "bumping." · Changes Career Service employees to serving at the pleasure of the Agency Head ("at will"). · Shifts "burden of proof" in suspensions or dismissals to the employee to establish the Agency Head had abused his/her authority. · Requires that adverse agency actions go to Circuit Court. · Mandates "automatic direct deposit" of employees' payroll. · Imposes service charge for any employee-requested wage deduction (dues, United Way, Supplemental Insurance). · Repeals Meritorious Service Award Program. · Creates "gainsharing" program without standards. · Eliminates mandated Supervisory/Management Training Programs. · Puts certain Education and Training programs at sole discretion of Agency Head (tuition free). · Increases Senior Management Cap. · Abolishes current review and performance system requirement to document all recommendations for salary increases, promotions, demotions, transfers or dismissals.
