Appendix Pages 26 and 27

IN THE CIRCUIT COURT OF THE 20TH JUDICIAL CIRCUIT IN AND FOR LEE COUNTY, FLORIDA. CRIMINAL ACTION.

THE STATE OF FLORIDA

V.

ROBERT F. ALLSTON
Defendant

Case No. 94-803CF

ORDER
THIS CAUSE having come before the court upon receipt of the attached communication from the Defendant which he has requested be filed as a Complaint for Declaratory judgment. Apparently this matter is addressed to the undersigned because the undersigned is the judge in several mortgage foreclosure cases pending against this Defendant. The subject matter of the request for declaration concerns the Defendant's criminal case and his conditions at the stockade. Under the circumstances, it is appropriate that this matter be filed in the Defendant's criminal case and that the matters be addressed by the judge assigned to that case. It is therefore

ORDERED AND ADJUDGED that the attached documents purporting to be a letter and a Complaint for Declaratory Judgment shall be filed as attached in the above captioned criminal case. It is further

ORDERED AND ADJUDGED that a copy of this Order together with the attachments will be delivered to the Judge assigned to the Defendant's criminal case and to the Defendant's public defender for such hearing and other consideration as that Judge may see fit to give them. It is further

ORDERED AND ADJUDGED that the attachments will only be included with the copy placed in the court file, the copy sent to the Judge and the copy sent to the Public Defender and only the original will contain a copy of the Lee County Corrections Bureau Inmate Rules and Orientation and Information Handbook.

DONE AND ORDERED in Chambers at Fort Myers, Lee County, Florida this 14 day of October, 1994.
