In the name and by authority of the State of Florida:
Dean R. Plattner, Assistant State Attorney of the Twentieth Judicial Circuit of the State of Florida, prosecuting for the State of Florida, in the County of Lee under oath information makes that Robert F. Allston, late of the County and State aforesaid, in the County and State aforesaid on or about March 23, 1994,
Count 1
did threaten unlawful harm to a public servant, to wit: Lee County
Commissioner, Ray Judah, or to any other person with whose welfare he is
interested, with the intent or purpose to influence the performance of any
act of omission which he believed to be within the official discretion of
said public servant, in violation of a public duty, or in performance of a
public duty,
Count 2
did unlawfully write or compose, and also send or procure the sending of a
letter or other written communication, to another person, to wit: Lee
County Commissioner Ray Judah, containing a threat to kill or do bodily
injury to the person such letter or communication was sent,
Count 3
did threaten unlawful harm to a public servant, to wit: Assistant Lee
County Attorney David Owen, or to any other employee of the Lee County
Attorney's Office, with the intent or purpose to influence the performance
of any act or omission which he believed to be within the official
discretion of the public servant, in violation of a public duty, or in
performance of a public duty,
Count 4
did unlawfully write or compose, and also send or procure the sending of a
letter or other written communication, to another person, to wit:
Assistant County Attorney David Owen, containing a threat to kill or do
bodily injury to the person to whom the letter was sent, contrary to the
statute in such case made and provided and against the peace and dignity
of the State of Florida.
