Attached hereto are exact copies of a cover letter and Notice of Appeal from defendant dated 12/2/94, and sent to the clerk for filing. Defendant checked with the clerk on 12/28/94 and 1/20/95, and with his counsel, Frank Alderman, III, Esq., on 1/12/95 and his Notice of Appeal could not be located. However the attached copies were received from Frank Alderman, III, Esq., in the U.S. mail on 1/23/95, by defendant. Defendant is proceeding in this appeal entirely by himself, pro se.

Wherefore defendant respectfully requests the clerk to accept this Addendum and the enclosed Notice of Appeal together for filing in replacement of the original Notice of Appeal and that the time allowed for filing a brief and other actions of the parties run from the time of filing this replacement.
