  1                      A bill to be entitled

  2         An act relating to speed-measuring devices;

  3         creating s. 316.1907, F.S.; prohibiting the use

  4         of devices that detect or interfere with

  5         speed-measuring devices used by law enforcement

  6         agencies; providing that enforcement must be

  7         secondary; providing penalties; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Section 316.1907, Florida Statutes, is

13  created to read:

14         316.1907  Radar or laser speed-measuring device

15  detectors or jammers prohibited; penalties.--

16         (1)  A driver may not operate a motor vehicle on a

17  street or highway in this state if the vehicle is equipped

18  with a device that is in operating condition and readily

19  accessible for use by the driver or any passenger and that

20  detects, jams, or otherwise interferes with the operation of a

21  radar, as defined in s. 316.1906, operated by a law

22  enforcement officer.

23         (2)  Enforcement of this section by state or local law

24  enforcement agencies must be accomplished only as a secondary

25  action when a driver of a motor vehicle has been detained for

26  a suspected violation of another section of this chapter,

27  chapter 320, or chapter 322.

28         (3)  A violation of this section is a noncriminal

29  traffic infraction, punishable as a moving violation as

30  provided in chapter 318.

31         Section 2.  This act shall take effect July 1, 2007.
