        Whereas in the action of H.H. Powels heirs
against H.H. Powels heirs then pending in the Webster
Circuit Court an order was entered at the December
Term 1893 directing C.C. Hardwick Master Commissioner
of said court to expose for sale at public auction the
property hereinafter described and whereas said prop-
erty was sold in accordance with said order on 
the 15th day of January 1894 and for the sum of one
hundred and seventy one dollars and shereas
the report of said sale was confirmed by said court
at the April Term 1894 and the Term 1894 and order
was entered directing the Commissioner to execute
a deed of conveyance of said property L.W. Powell
the purchaser now therefore this indenture made
and entered into this 7 day of August 1894 between
H.P. Powell  Pulina Powell Homes Isaac Homes

Commissioner of the said court of the first and
L.W. Powell of the second part Witnesseth that for
and in consideration of the premises and for
the further consideration of the full payment of the
purchase price aforesaid the receipt whereof is hereby
acknowledged the parties of the part by C.C. Hardwick
as Commissioner aforesaid have sold and by
this writing does convey to said party of the
second part and his heirs and assigns forever
the following described property to wit Three Tracts 
of land lying and being in Webster County
Kentucky on the waters of Highland Creek the
first tract bounded as follows Beginning at the south
east corner at a stone in the Newman line thence
N85 W52 2/3 poles to a stone in the Gibson line thence
N10 1/3 poles to a hickory Gibson's corner thence
E54 1/2 poles to a black gum in the Newman line
corner Forshe thence S5 W28 1/2 poles to the beginning
containing six acres the second tract Beginning
at N.E. corner at a stone in the Newman line
running thence N85 W38 2/3 poles to a stake near
oak post oak in Gibsons line thence S85 1/3 poles
to a stone Gibsons corner in Prices line thence E
44 poles with Prices line to a stake and oak in
N. Lenards line thence with N. Lenards line N85
E24 1/3 poles to a stake and two red oaks N. Lenards
corner thence N85 W31 1/2 poles to a stone the New-
man corner thence N85 E40 1/3 to the beginning con-
taining Sixteen acres And the third tract
Beginning at a planted stone in the Newman 
line running with said line S18 1/2 W22 poles
to a stone thence N71 1/2 W41 1/2 poles to a stone in
Henry Ashers line thence with his line N2 E27
poles and 3 links to a stone thence S67 1/4 E51 1/2
poles to the beginning containing 6 7/8 acres
       To have and to hold the said property
together with the rights and privileges and appur-
tenances thereunto unto the party of the second 
part his and his heirs and assigns forever
the parties of the first part by said C.C. Hardwick
as Master Commissioner hereby covenant with
the party of the second part that they will war

premises hereby conveyed against the claims of all
parties to this action.
    In Testimony whereof said C.C. Hardwick as
Commissioner aforesaid has signed his name hereto
subscribed his name this 7" day of August 1894.

     I, Jno G. Jenkins Clerk of the Webster Circuit
Court, do hereby certify that this deed, from H.P. Powell &c
to L.W. Powell was on the 7th day of Aug. 1894, pre
sented to open court by said C.C. Hardwick Com
missioner, and was by him duly acknowledged
to be his act and deed and the said deed, having
been examinrd by the court, was approved and
confirmed, and so endorsed by the judge, and
ordered to be transmitted, duly certified, to the Clerk
of Webster County Court for record, which is now
done accordingly.
     Witness my signature, this 30 day of Aug, 1894

   I, J.T. Skinner clerk of the Webster County Court,
do hereby certify that the foregoing deed, from C.C.
Hardwick late commissioner of the Webster Circuit
Court, to L.W. Powell was produced to me in my
office on the 13 day of April 1895 certified as above
for record, whereupon the same and the foregoing, and
this certificate have been recorded in my office.
